Terms & Conditions

Please read this notice.It constitutes part of your contract for travel related services.

Untraced Paths Travellers LLP. requires this TRAVEL APPLICATION and included TERMS&CONDITIONS and RELEASE OF LIABILITY, WAIVER, INDEMNIFICATION, AND ASSUMPTION OF RISKS document to process your booking. If you fail to accept these while booking or submit these or any and all forms provided to you by the tour operator(s)/supplier(s), you will not be allowed to join the trip. 

Untraced Paths Travellers LLP, registered with Ministry of Corporate Affairs, India, hereinafter referred as ‘Company’ having its head office located at Shop No. G-9, Madeira Enclave, Fatorda, Goa 403602, gives notice that someservices provided in connection with the itineraries are rendered by suppliers who are not agents or employeesof the Company. All of the accommodations, meals, tours, cruises, air ground and water transportation, and/or relatedtravel services made by the Company are made solely as an agent for the individual participant and not directlysupplied by the Company. While every effort is made to make travel arrangements with reputable suppliers, theparticipant expressly agrees that the Company shall not be responsible for breach of contract, failure to complywithany local laws prevalent or any intentional or negligent actions or omissions on the part of such suppliers, whichresult in any loss, property damage, delay, change of itinerary irregularity, inconvenience, bodily injury, or deathtotravellers or travellers’ companions or group members or any wrongful or intentional acts, breach of contract, ordefault of any company or individual engaged in providing these arranged services. 

Untraced Paths Travellers LLP., its principals, guides, and agents shall not be responsible for any injuries, physical exertion for which the participant may not be prepared, losses or damages in connection with terrorist activities, social, civil or labour unrest, political disputes, failure of mechanical or structural integrity of air, sea, andgroundtransportation and accommodations, diseases, sicknesses, local laws, kidnapping, high altitude on hills, badclimaticconditions not limited to strong winds, heavy rainfall, heatwaves, flooding etc, acts of God, exhaustion due toheatand humidity, consumption of alcoholic beverages and/or other illegal substances, dangers associated withwildorother animals/insects/reptiles/birds/fish, quality of medical and telecommunications/internet services inremoteareas, theft, problem associated with lost or misplaced luggage, delays, changes or cancellation of travel duetoweather conditions, hotel services, accidents or health related problems before or while in-transit to (e.g., anaccident on the way to a tour), during, and after a tour, flight changes or cancellation, missed connections, or anyother actions, omissions, or conditions outside of the Company’s control. By embarking upon his/her travel, the traveler voluntarily assumes all risks involved in such travel, whether expected or unexpected. Traveller is hereby warned of the above risks as well as possible travel industry bankruptcies and medical and climatic disruptions, and the possibility traveller may be unable to travel as scheduled because of a personal emergency. 

Untraced Paths Travellers LLP. and its principles, guides and agents are not qualified first aid or medical care providers and can assume no liability to provide first aid or medical care. The Company reserves the right to decline, to accept, or to retain and disqualify from the entire trip, or any portion of the trip, any person whose conduct or physical health impedes trip operation or infringes on the rights, welfare, or enjoyment of other trip members. A refund for unused services will not be given under such circumstances. 

Media Release

Untraced Paths Travellers LLP. and/or its representatives may take photos or videos during the operation of any program and use them for promotional purposes. By booking a program with the company, participants agree to allow their images to be used in such photos. Participants also agree that any feedback, testimonials, or comments provided to Untraced Paths Travellers LLP. may be used for promotional purposes. If you prefer that your images to not be used, please notify us before such booking is made. 

Participant Responsibilities

The participant expressly agrees that they shall be solely responsible for any intentional or negligent actions or omissions on their part, that result in any loss, property damage, inconvenience, bodily injury, or death to Suppliers or Suppliers’ companions or group members or of any company or individual engaged in providing these arranged services, and the Company shall not be liable to be sued or to compensate for the losses arising out of the above mentioned. Every participant will be responsible for comprehending the conditions stated and implied in their trip description/itinerary and for selecting a trip that is appropriate to his/her interest (s) and abilities; for disclosing in writing and/or during the initial phone or email consultation any potentially relevant medical or health conditions to the Company; for preparing for the trip by reading the trip itinerary(ies) and all supplemental trip information supplied by the Company or other relevant suppliers; for discussing this itinerary with their physician; for bringing appropriate clothing and gear/equipment as instructed; for following normal standards of personal hygiene and personal safety as advised by the trip leader, local guides, and/or the Company, in order to lessen the risk of travellers’ diseases or injuries; for adhering to the reasonable directives of the tour leader and/or local guide(s); for acting in an appropriate social manner with fellow trip members when on a group trip; for acting in an appropriate and respectful manner in accordance with the customs of the places visited on each and every trip; and for completing the trip itinerary when traveling on group programs. 

Insurance

The Company doesn’t offer travel insurance in the tour/package. 

Pricing

Careful planning has allowed Untraced Paths Travellers LLP. to set the price it offers to you and everything reasonable will be done to guarantee that price. However, price adjustments may be made (even on existing bookings) in the rare event of extreme currency fluctuations, post-booking fuel surcharge assessments, and other similarly unforeseeable events outside the control of the Company and/or our suppliers. This shall be intimated to the participants before the start of the tour/trip. Not included in the price are: items not mentioned in the agreed plan, items of a personal nature such as laundry services, beverages, medical costs, the costs of hospitalization and evacuation from remote areas, and additional expenses arising from delays or extension of a trip due to weather, political dispute, sickness, failure of transportation or other causes beyond the Company’s control. 

Payment

All payments are to be made to Untraced Paths Travellers LLP. by cheque, cash, or through the secure eCommerce interface. Your reservation may be cancelled (in some cases automatically) if payment is not received before 48 hours of the scheduled Tour/Package. The payment for a reservation on the chosen Tour/Package shall bein full. 

Cancellations, Rescheduling, Changes & Refunds

If you should ever find yourself in the unfortunate situation of having to change or cancel your trip, you must notify us as soon as you know that you have to cancel, so your cancellation can be processed in a timely manner. Notice of change or cancellation must be sent in writing by the Traveler or via email, message or phone to Untraced Paths Travellers LLP. If the Tour/Package is canceled before 24 hours, the booking amount shall be fully refunded to the participant. If the Tour/Package is cancelled before 12 hours, only 50% of the booking amount shall be fully refunded to the participant. There shall be no refund for cancellations of the Tour/Package if it is scheduled for time less than 12 hours. 

If travel plans are delayed or cancelled for any reason there will be no refunds issued by Untraced Paths TravellersLLP., except in those circumstances where the Company has issued its own schedule of cancellation. No refund(s) will be issued for cancellations due to actual or threatened terrorist events. Furthermore, there will be no refunds due to fear of travel from actual or threatened terrorist, health, political, or other similar events. If the trip is cancelled due to forces beyond Untraced Paths Travellers LLP’s. control (e.g., acts of God, war, strikes, etc.), The Company will promptly refund the portion of the trip cost not advanced to suppliers or recoverable from suppliers. Many expenses, including transportation, and transaction fees are non-recoverable and as such, completely NON-REFUNDABLE. UntracedPaths Travellers LLP. will use its best efforts to recover advance payments as promptly as possible and refund the amount recovered, if any. However, the Company does not guarantee recovery of any or all of the advance payments made. 

Dispute

Any dispute arising out of the above terms and conditions shall be resolved by mediation at the first instance, A recourse to Arbitration shall be taken if the dispute is not resolved at the mediation stage. The jurisdiction for filing disputes arising out of the above contract of terms and conditions shall be in the place of the registered office address of the company. 

Note

In case of bookings made by a single person on behalf of multiple people, the concerned person agrees to take complete responsibility for the people being booked for.

Furthermore, to better tailor our website and product offerings to our customers, we use Google Analytics to collect information on how visitors navigate our website. Cookies are used to collect aggregated data that allows us to see the origins of web traffic, amount of visitors, visitors’ operating systems, browser types, etc. This data does not personally identify you in any way. You can choose not to accept cookies by disabling them in the settings of your web browser.

Bookings & Payments

When you book a tour on our website, we require contact information, such as your name and e-mail address and, in some cases, partial or full postal address or telephone number. This information is only used to contact you with information about your tour. In rare cases, we may need to share your contact information with tour guides who are responsible for the booked tour. Otherwise, we do not sell or share this information with any third parties.

At the time of booking, we also ask you for payment information such as credit card number or bank transfer details. We use the utmost level of online security to safeguard your personal data. 

Online Security

Our website is protected by the utmost level of online security, meaning your personal data is safe with us. All transactions on the site are secured by COMODO and any data we gather from users is securely stored and safeguarded by the best firewalls available.
